Jack Stuart will provide a discussion on three particularly interesting cases on liability and quantum from 2022-23 in the area of personal injury, specifically:

  1. MXX v A Secondary School [2022] EWHC 2207 (QB), a decision tackling the issue of vicarious liability in the context of torts committed by a school’s former pupil on ‘work experience’.
  2. Juj v John Lewis Partnership Plc [2022] EWHC 2418 (KB), a recent decision on occupiers’ liability which dealt with the interplay between the degree of an occupier’s control and the extent of their duties as occupier.
  3. Rabot v Hassam; Briggs v Laditan [2023] EWCA Civ 19, the Court of Appeal decision giving guidance on how to approach valuing ‘Mixed Injuries’ cases following the reforms brought in by the Civil Liability Act 2018.
